A tort law case basically comprises four main elements namely: duty, breach of duty, causation, and injuries. For any strong tort law case there must be a breach of duty caused by someone that resulted in an injury to another person. The code will then determine if the injured party should be awarded damage or not. There are three main types of tort law cases:

Intentional Tort:

When a person deliberately violates someone else’s rights such as the right to privacy, emotional harmony and safety such actions are categorized under intentional torts. Examples of intentional tort law cases:

  • If a person strikes someone in a fight with an intention to harm them will be categorized as an intentional tort.
  • If two people are fighting and one person hits another but they did not have the intention to harm the other. This will still be considered as an intentional tort case as the person did had the intention to hit them in the first place.

Therefore, anything that comes under the category of assault, fraud, trespass, false imprisonment and intentional emotional distress will be called an intentional tort law case.

Negligence Tort:

It is the most prevalent kind of tort law. Any harm that is caused due to the careless behaviour of one person falls under the negligence tort case. In a society, it is the legal duty of an individual to follow a certain code of conduct and act in a way that does not cause harm to other people. But sometimes people fail to follow these standards of the society and hence unintentionally are obligated under a tort law case. Such cases are called negligence tort law cases. Here are some examples of negligence tort law cases:

  • If a person breaks the red light and that causes a car accident. Although the person had no intention to cause an accident their careless behaviour resulted in such harm.
  • If a property owner does not behave reasonably with his visitors to customers.

Therefore, anything that comes under the category of accidents such as car, truck, motorcycle, bicycle, and pedestrian accidents or slip and fall accidents are the cases of negligence tort law. Medical malpractice can also be regarded as negligence tort law case.

Strict Liability Tort:

It is another famous category of tort law cases in which the person being caused harm can impose its responsibility on the wrongdoer without any proof of intentional damage or negligence. If an action has occurred that caused injuries to another person then this much information is enough to impose a strict liability tort law case. Here are some examples of the strict liability tort law case:

  • If a company sells products to the customer that are malfunctioned and that causes some harm to the customers then this is a case of strict liability tort law. Although the company has no intention to hurt their customer their product was damaged and has thus harmed the customer so the customer can claim damage from the court under the process of strict or absolute liability tort law.
